Waiver of Liability and Release of Claims

Waiver Agreement

In consideration of being permitted to enter the premises of Ironworks Fitness (the “Gym”), located at 2557 Capitol Dr. Creedmoor, NC 27522, and/or to participate in any fitness classes, training sessions, use of equipment, or any other activities offered by Ironworks Fitness (“Activities”), the undersigned hereby acknowledges and agrees as follows:

1. Assumption of Risk

   
   

   I understand and acknowledge that participation in the Activities involves inherent risks, including but not limited to:

   • Serious injury or death from use of weights, machines, cardiovascular equipment, or other fitness apparatus

   • Slips, falls, collisions, or equipment failure

   • Overexertion, dehydration, heart attack, stroke, or other medical conditions

   • Exposure to infectious diseases (including but not limited to COVID-19)

   • Negligence of other participants or third parties

   I knowingly and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of Ironworks Fitness, its employees, officers, agents, landlords, property owners, or other participants.

   
   

2. Release and Waiver of Liability

   
   

   I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby forever release, waive, discharge, and covenant not to sue:

   • Ironworks Fitness LLC (or appropriate entity name)

   • Its owners, members, managers, employees, instructors, contractors, and agents

   • The property owner(s), landlord(s), and management company of the premises

     
     

     (collectively, the “Released Parties”)

   from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury (including death), or property damage that may occur as a result of my presence on the premises or participation in the Activities, whether caused by the negligence of the Released Parties or otherwise.

   
   

3. Indemnification

   
   

   I agree to indemnify, defend, and hold harmless the Released Parties from any claims, losses, liabilities, damages, expenses (including reasonable attorneys’ fees), or demands brought by any third party, including my family members or estate, arising from or related to my participation in the Activities or presence on the premises.

   
   

4. Physical Condition and Medical Approval

   
   

   I represent that I am in good physical condition and have no medical or physical condition that would prevent me from safely participating in the Activities. I have consulted (or had the opportunity to consult) with a physician regarding my participation. In the event of a medical emergency, I authorize Ironworks Fitness staff to seek emergency medical treatment on my behalf.

   
   

5. Photo/Video Release

   
   

   I grant Ironworks Fitness permission to use photographs, videos, or other recordings of me taken at the Gym for promotional or marketing purposes without compensation.

   
   

6. Governing Law & Severability

   
   

   This Agreement shall be governed by the laws of the State of North Carolina. If any portion of this Agreement is found to be unenforceable, the remaining portions shall remain in full force and effect.
